When court proceedings are threatened, it can often be scary and daunting for people. This may be...
It is sadly the case that individuals can be let down by their professional advisers. These can be solicitors, will writers, accountants, tax advisers and financial advisers.
Reasons for Professional Negligence claims against professional advisers
There are many reasons a claim could be possible against a professional adviser, but at the root of them is that the adviser did not provide the level of professional advice you would expect them to.
Some examples where this may happen in relation to Wills and Trusts include:
- A Will or Trust doesn’t do what a person has intended and therefore the wrong people benefit.
- A Will or Trust may create an unexpected liability for tax which could have been avoided. As a result, the beneficiaries are left with nothing or a lot less than was intended.
- A trustee or executor takes poor investment advice that causes a loss for the estate or trust fund.
In these and many other circumstances, we may be able to pursue a claim against the adviser to recover any financial loss from them or their insurers.
We frequently act for disappointed beneficiaries, trustees and executors in bringing claims against advisers when they are negligent.
Although these can be complex claims, they may often be resolved without the need to issue Court proceedings.
We are experts in pursuing these claims and successfully recovering money from the professionals for our clients.
