Our legal services in Abingdon

Agricultural and rural land transactions

Acquiring or disposing of agricultural land involves a level of complexity that goes well beyond a standard property transaction. Whether you are purchasing a working farm, selling an agricultural estate or pursuing a strategic land acquisition, the legal framework around agricultural assets requires specialist knowledge and careful handling.

Our agricultural solicitors in Abingdon advise across the full range of rural land transactions. We carry out thorough due diligence at the outset, examining titles, boundaries, existing tenancy arrangements, subsidies, environmental designations and any other factors that could affect the value or use of the land.

Development and land use

The commercial potential of agricultural and rural land has expanded significantly in recent years, from renewable energy projects to large-scale residential development. Realising that potential, however, requires robust legal arrangements from the outset.

Our development and land use solicitors advise landowners and rural businesses on the full range of development and land use matters. Where land is being promoted for planning, we can advise on and draft promotion agreements that set out the terms on which a promoter will seek planning permission on your behalf, including how proceeds will be shared on a successful sale.

Estate and rural business structuring

Running a landed estate or a diversified rural enterprise involves balancing a range of competing priorities: preserving the value of the asset, managing it efficiently, minimising tax exposure and planning for the future. Getting the legal structure right is fundamental to achieving all of these at once.

Our estate and rural business structuring solicitors in Oxfordshire work closely with landowners and rural business operators to review and advise on the structure of their holdings. For landed estates, this includes reviewing how ownership is held, whether through individuals, partnerships, companies or trusts, and identifying whether the current arrangements support the client's long-term objectives.

Agricultural tenancies and occupation

Agricultural tenancy law is a specialist area with distinct rules, rights and obligations that differ significantly from ordinary landlord and tenant law. Whether you are a landlord letting agricultural land or a tenant in occupation, having the right legal advice is essential.

Our Abingdon solicitors advise on all forms of agricultural tenancy and occupation. For tenancies governed by the Agricultural Holdings Act 1986 (AHA), we advise both landlords and tenants on their statutory rights, including succession rights, rent reviews, notices to quit, and dispute resolution.

For farm business tenancies (FBT) under the Agricultural Tenancies Act 1995, we advise on the drafting and negotiation of agreements, break clauses, rent review mechanisms and end-of-tenancy arrangements.

Tax planning for landowners

For landowners, the tax implications of decisions around land ownership, transfer and disposal can be significant and long-lasting. Proactive, specialist advice is the best way to ensure your affairs are structured in a way that protects the value of your assets and supports your plans for the future.

Our solicitors advise on a wide range of tax matters affecting rural landowners. On disposals of agricultural land, we advise on capital gains tax (CGT) planning, including the use of rollover relief, holdover relief and entrepreneurs' relief where applicable. We work closely with clients to identify the most tax-efficient route to a sale or transfer.

Inheritance and succession planning

Passing a farm or rural estate from one generation to the next is one of the most significant legal and financial events a farming family will face. Without careful planning, the process can give rise to disputes, unexpected tax liabilities and disruption to the business at a time when continuity matters most.

Our solicitors in Abingdon work with landowners and their families to put in place succession strategies that reflect both the commercial realities and the personal dynamics involved. We advise on how ownership should be structured to facilitate a smooth transition, whether through lifetime gifts, the use of trusts, partnership restructuring or a combination of approaches.

Rural property disputes and advisory

Disputes over rural land can be costly, time-consuming and damaging to relationships that may have existed for generations. Whether the issue concerns a boundary, a right of way, a title defect or a question of ownership, specialist legal advice at an early stage can make a significant difference to the outcome.

Our Abingdon team advise on a wide range of rural property disputes. Boundary disputes often arise where the paper title does not reflect long-standing use or occupation on the ground, and resolving them requires a careful analysis of title deeds, historic maps and witness evidence. Rights of way and access disputes are similarly fact-intensive, and our team has considerable experience advising both those seeking to assert a right and those looking to resist or limit one.
