Initial divorce advice
If you are separating and considering a divorce or civil partnership dissolution, we can give you initial advice on your situation and the matters that you must address.
We can discuss issues such as whether a separation agreement is needed, the benefits of a child arrangements order, divorce costs and potential timescales. Applying for a divorce or civil partnership dissolution
When obtaining a divorce, dealing with other matters before the actual divorce is finalised is usually advisable. The main requirement is to put a financial order in place that deals with the division of property and other assets and arrangements for any children that you may have. Once other issues have been dealt with, we can make an application to the court for a divorce.
Once the application has been sent, there is a cooling-off period of 20 weeks. After this time, we can ask the court for a conditional order. We can request a final order six weeks and one day after the conditional order is made. This is the document that will complete the process.

Financial orders
It is essential to have a financial order made when you divorce or dissolve your civil partnership. Without this, there is a risk that a claim could be made against you in the future.
A financial order can be made by consent if you and your former partner agree on how to split your assets and debts.
Our team will work to try and help you find an acceptable solution out of court. This is beneficial for several reasons, including speed, cost-efficiency and reducing conflict.
We can negotiate with your partner’s solicitor to see if we can agree on a fair division of assets. If necessary, we can refer you to mediation, where a neutral mediator will meet with you both to help you explore potential solutions.
There are also other types of alternative dispute resolution that may be helpful, including collaborative law and arbitration. Again, these are faster than court and generally less expensive.
If an agreement is reached, the court can be asked to seal this, making a binding financial order. If you cannot agree, then we can ask the court to decide the issues in question and make an order in the terms it believes are fair.

Child arrangements orders
One of the hardest parts of a divorce is making new arrangements for children. We can represent you in negotiations to try and agree on how matters will be dealt with. If you have children, then you can have a child arrangements order made. This will set out details of where your child will live, how much time they will spend with each parent and how they will keep in touch with you while you are not together.
We can negotiate with the solicitor for your child’s other parent to try and agree on the details. Where this is not possible, you will need to consider mediation as a next step unless domestic violence is a factor.
If you can agree on arrangements during mediation, the court can approve these and make a child arrangements order. If you are not able to agree, then an application can be made to the court asking it to decide matters. The court will generally involve the Children and Family Court Advisory and Support Service or Cafcass, which will work with you and your family to prepare reports to help the court make the right decisions.

We can apply to the court for an injunction on your behalf where necessary. This includes:
- A non-molestation order, preventing someone from harming, harassing or intimidating you or your child.
- An occupation order, setting out how your home can be occupied and who can enter the property.
- A prohibited steps order, preventing someone from taking a particular action in relation to your child, such as taking them overseas or removing them from their school.
- A specific issue order, setting out what will happen in a particular situation, such as changing a child’s name, having medical treatment or relocating.
