Domestic Violence

If you, a close friend or a relative has been harmed or is at risk of harm you should take action immediately. Domestic violence is an ever present issue in today’s society which affects all people regardless of their age, gender or sexuality.

Many people find it hard to talk about abuse and many people are in fact unaware that they, or a loved one, may be suffering from abuse.

There is no statutory definition of domestic violence. The cross-governmental definition is "any incident or pattern of incidents of controlling, coercive, threatening behaviour, violence or abuse between those aged 16 or over who are, or have been, intimate partners or family members regardless of gender or sexuality". Domestic violence may occur in many different forms such as psychological, physical, sexual, financial or emotional abuse. It is therefore important that you seek expert advice so that you know where you stand.

If you or someone you know is suffering harm or at risk of suffering harm then there are steps which you can take. You can seek injunctive relief from the Courts by way of:

  • a Non-Molestation Order (i.e. an Order prohibiting an associated person from molesting you or a relevant child; or,
  • an Occupation Order (i.e. an Order regulating the occupation of a property).
