The personal injury campaign focuses on why it is important for accident victims to seek proper legal advice from a solicitor, and to think twice before accepting an initial offer of settlement from an insurance company.
Your opponent’s insurance company will sometimes put forward a monetary offer at the start of your personal injury claim. The offer may seem appealing at the time, however, the offer (commonly referred to as a “pre-medical offer”) is designed to encourage you to settle without having first obtained medical evidence, consulted a solicitor and obtained advice regarding the correct value of your claim.
Claimants are often unaware that once a settlement has been agreed a binding legal contract is formed to settle for that sum. Therefore if you later discover that you are suffering ongoing symptoms as a result of your accident, and have incurred additional expenses such as loss of earnings, treatment costs and medical expenses you will be unable to raise a further claim.
According to the Financial Services Authority, accident victims who turn down an insurance company’s first offer and take legal advice from a solicitor will receive on average two to three times more personal injury compensation.
