New law to clamp down on uninsured drivers 27/07/2011

A new scheme known as the “CIE” (Continuous Insurance Enforcement) came into force 20 June 2011.  This new law will make it illegal to own a vehicle without it being insured however, you will be exempt if you have declared a SORN (Statutory Off Road Notice) with the DVLA.

The DVLA will work in partnership with the “MIB” (Motor Insurers Bureau) to indentify vehicles with no insurance and an Insurance Advisory Letter (IAL) will be issued to the registered keeper of the vehicle warning of the action that may be taken if they fail to comply.  If a registered keeper fails to take any action, they could face the following:

1.         A fixed penalty notice of £100

2.         Possibility their vehicle will be clamped, seized and destroyed

3.         A court prosecution that carries a maximum fine of £1,000.00.

Research taken from the Department for Transport website suggests that uninsured drivers add about £30 to every insured person’s motor insurance premium a year.  In addition, it is estimated that uninsured and untraced drivers are responsible for approximately 160 deaths per year and 23,000 injuries a year.  Road safety Minister Mike Penning has said:

"Uninsured drivers push up premiums for other motorists and often drive with no regard for other road users, so it is vital that we do everything we can to keep them off the roads.”

Further research from the MIB website states that:-

  • 1 in every 10, 18-34 year old drivers are unaware car insurance is a legal requirement

  • About 900,000 drivers under the age of 30 are currently driving without insurance

  • 60% of drivers think they are unlikely to be caught and only 7% are aware of the possible consequences

If you have been a victim of a road traffic accident which was not your fault and you believe the other party may have been uninsured or untraced, you may still be entitled to pursue a personal injury compensation claim.
